The rules
What stays with your licensed people.

Rates, terms and the application. Under the SAFE Act, taking a mortgage application and offering or negotiating its terms is the work of a loan originator licensed through NMLS. The system never quotes a rate, presents terms, recommends a loan or a lender, or helps a borrower fill in the application. CFPB: who must be licensed (Regulation H) (opens in a new tab)

What it does instead. General answers about the process, collecting and assembling documents, a loan's status and booking the call, set up and overseen by your licensed loan officer. The rules treat that as support work, not loan origination. CFPB: Regulation Z, comment 36(a)-4 (opens in a new tab)

Credit decisions and fair lending. The system never pre-qualifies, scores or turns anyone away. Under the Equal Credit Opportunity Act a broker may not discriminate against an applicant on a prohibited basis, such as race, sex, age or marital status, so every inquiry gets the same questions and the same follow-up. Borrower documents. Pay stubs, tax returns and bank statements are customer information under the FTC's Safeguards Rule, which names mortgage brokers among the businesses it covers and asks for encryption and multi-factor login. Consent for texts and calls. Automated texts and AI voice calls need the borrower's consent under the Telephone Consumer Protection Act. In February 2024 the FCC ruled that an AI-generated voice counts as an artificial voice under that law. Replying to someone who contacted you first is where these systems start. Can an AI talk to borrowers if it has no NMLS license?
It answers general questions about the process, collects documents, gives a loan's status and books the call, overseen by your licensed loan officer. The rules treat that as support work. Taking the application and anything about rates or terms is your licensed loan originator's work, so the system hands those over with what was said so far.
Can the AI quote rates or pre-qualify a borrower?
No. It never quotes a rate, presents terms, suggests a loan program or a lender, or says whether someone is likely to qualify. A borrower who asks is booked with your loan officer, or handed to them at once.
Will it replace my processor or my loan officer assistant?
No. It takes the chasing and the status questions nobody gets to, and hands your processor a file that says what is in and what is missing. Every decision on the file stays with your people.
Is it safe to collect borrower documents with AI?
Documents go into your POS or LOS, not into an email inbox or a chat thread. The FTC's Safeguards Rule covers mortgage brokers and asks for encryption and multi-factor login, so the system is set up inside the safeguards you already keep, with only the access the job needs.
Can it text my old leads and past clients?
